Phỏng vấn nữ luật sư Lê thị Công Nhân, phát ngôn nhân của Đảng Thăng Tiến

Sau khi phong trào ủng hộ dân chủ tại Việt Nam, khối 8406, ra đời, nhiều thanh niên và trí thức trẻ đã ký tên tham gia. Nữ luật sư Lê thị Công Nhân tại Hà Nội là một trong số những bạn trẻ đó; và không chỉ tham gia Khối 8406, cô còn là phát ngôn nhân của Đảng Thăng Tiến, một đảng mới ra đời tại Việt Nam vào đầu tháng chín này. Upon the birth of 8406 movement for Freedom & Democracy in Vietnam, many young Vietnam professionals had signed the Declaration or becoming member. Le Thi Cong Nhan, a female attorney was one of those professionals. She not just only signed her name on the Declaration for Freedom & Democracy in Vietnam, but became the Spokeswoman of the Vietnam Progression Party, a newly political organization established in Vietnam on the beginning of September 2006.

Ngay sau khi tên tuổi của nữ luật sư Lê Thị Công Nhân được công khai trong đảng Thăng Tiến, thì cô đã bị công an tại Hà Nội mời đi làm việc. Right after Vietnam Progression Party released her name and her spokesperson title to the public,  the so-called Cong An of the current regime police CALLED on her for their autocracy-style interrogation.

Gia Minh hỏi chuyện nữ luật sư Lê Thị Công Nhân về một số thông tin liên quan họat động ủng hộ và đấu tranh cho dân chủ, nhân quyền tại Việt Nam của bản thân cô. Journalist Gia Minh of RFA interviews the brave Spokeswoman of the Vietnam Progression Party about the effort to bring about Democracy and Freedom in Vietnam. Trước hết, nữ luật sư Lê thị Công Nhân nhận định về những cuộc làm việc với công an vừa qua: First of all, spokesperson Le Thi Cong Nhan provided her analysis about the Cong An officials through the interrogation.

Tinh thần những buổi gặp đó theo tôi là; tôi cho đó là cơ hội để học cách ứng xử với cơ quan an ninh vì từ trước đến nay tôi chưa có bao giờ làm việc với công an. The spirit factor in these “meeting” was encouraging for me to learn about debating hot issues with public security official (Cong An) because I never had any chance to debate with them.

Gia Minh: Vì sao cô lại cho là tốt? What makes you say it was encouraging?

Luật sư Lê Thị Công Nhân: Vì tôi có cơ hội để nói cho họ rõ hơn về Đảng Thăng Tiến, mục tiêu và đuờng lối đấu tranh của Đảng Thăng Tiến Việt Nam. Because it brought me the opportunity to explain to them about the platform of the Vietnam Progression Party.

Gia Minh: Sau khi trình bày như vậy thì họ trả lời cô ra sao? How did they respond to your explanation?

Luật sư Lê Thị Công Nhân: Họ vẫn nói tôi phạm điều 79 Bộ Luật Hình sự Việt Nam là lật đổ chính quyền, và Đảng Thăng Tiến phạm vào điều 4 hiến pháp. They insisted that I violated article 79 of the Vietnam Criminal Law that is to overthrown the government, and the VN Progression Party (VNPP) violated the Article 4 of the Vietnam Constitution.

Qua những ngày làm việc với khá nhiều cán bộ an ninh điều tra, vì một mình tôi làm việc với bốn năm người; thì tôi thấy đó là do miếng cơm manh áo nên họ phải làm thế là đương nhiên; tôi cũng cảm nhận một thiểu số nhỏ trong họ có nhận thấy tình hình hiện nay. Having gone through many days of interrogation with many different officials for the same curiosity about VNPP, yet, I had to “face” with 4-5 officials by myself; I felt like they had to do their job for salary; however, I could see that some of them had seen the trend in the political situation.

Gia Minh: Sau ba ngày làm việc thì họ có đưa ra quyết định giải quyết ra sao? After 3 days of interrogation, did they come up with any determination?

Luật sư Lê Thị Công Nhân: Họ không có giải quyết gì về tư cách của tôi hết; họ chỉ nói tôi là ngừoi liên quan đến an ninh chính trị quốc gia và bắt tôi lên làm việc. Not really. They didn’t decide what to do about my position as VNPP’s spokesperson. They just insisted that I had been involved with national security and forced me to comply with the interrogation appointments.

Gia Minh: Cô có nói làm việc với công an là dịp tốt? You had said that facing such interrogation appointments are encouraging?

Luật sư Lê Thị Công Nhân: Đó là tôi nói trên tinh thần thiện chí và đối thọai, nhưng tất cả những sự trình bày và cố gắng của tôi sắp hết giới hạn rồi, vì trình bày một lúc cũng hết vấn đề; còn sau này là tùy vào ứng xử của nhà cầm quyền Việt Nam. Oh, what I said includes  my voluntarily effort to debate important issues. But my effort has almost reached the limit because I can present too many issues when they’re not ready to listen. Eventually, the ruler of Vietnam must respond appropriately to the hot issues that relevant to the people’s future.

Gia Minh: Hai bên không thể có một điểm chung nào? Is there common denominator between the two sides?

Luật sư Lê Thị Công Nhân: Có, nếu mà nhà cầm qyền Việt Nam hành xử theo đúng pháp luật; tức công dân có thể làm những điều gì mà nhà nước không cấm. Nếu họ làm thế thì hai bên có thể nói chuyện; nhưng họ cố tình không thực thi pháp luật. Tôi có thể khẳng định như thế vì tôi là luật sư nên tôi cũng có hiểu biết về pháp luật. You know, had there been any kind of common, the rulers would have done accordingly with the law and the citizen would have been able to do what the laws don’t prohibit them. Interestingly, if the rulers follow the set of rules created by them then the two sides can have good debate. Unfortunately, the rulers so determined not to follow the law they created. I am very sure about the rulers’ ignorance of the law since I am an attorney which helps me knows more less about the law being utilized.

Đảng Thăng Tiến Việt Nam mới ra đời 7 ngày tuổi đời và những cuộc gặp của tôi với cơ quan an ninh mới ba ngày thôi; nên so với những sự việc từng xảy ra cho những nhà đấu tranh cho dân chủ khác thì trường hợp của tôi được đánh giá là nhẹ nhàng nhất và ít có những phiền nhiễu nhất, nên tôi chưa thể nói gì khác những điều mới nói. The VNPP has been 7 days old and the meeting between myself and the state officials has been only 3 days; therefore in contrast with other democracy activists, my situation can be considered as a light weight ask-answer session and the least troublesome. I could not disclose anything other than what I said to them during these interrogations.

Gia Minh: Tinh thần cô chuẩn bị cho những cuộc gặp sắp đến khác thế nào? How would you be prepared psychologically for the coming interrogations by the officials?

Luật sư Lê Thị Công Nhân: Tinh thần này không cần cảm nhận mơ hồ, chính các công an đã chính thức nói với tôi là sau này nếu họ triệu tập nếu tôi không đi thì họ sẽ đến nhà đưa tôi đi. Mà anh biết đưa đi với còng số 8 và súng gí vào đầu thì không phải đưa đi. It is clear that the police has given me warnings that if I don’t show up at their office when they want me there then they will come to my resident with communist-style escort to the interrogations . And you know very well that the kind of escort with handcuffs and gun pointing at the head nobody can resist.

Họ đã vẽ ra cho tôi viễn cảnh nhà tù với 300 người với 2 toilét, ví dụ vậy. Tôi nghĩ tinh thần đó thì không phải cảm nhận nữa, mà tương lai sẽ rất căng thẳng. They has tried to discourage me with a prison facility having only 2 toilets to lockup 300 persons . And that is the kind of preparation for a lot of disaster ahead of me. 

Gia Minh: Cô đón nhận những điều đó ra sao? How would you take that kind of consequences?

Luật sư Lê Thị Công Nhân: Tôi đón nhận với tất cả những hiểu biết và những khả năng chủân bị tốt nhất có thể; nhưng nếu những điều đó xảy ra thì tôi kịch liệt lên án, phản đối đến tận cùng. I am prepared to take it with knowledge about the law and physical capability of a human-being; but I will oppose greatly and won’t stop fighting for basic human rights.

Tôi nay là đảng viên của Đảng Thăng Tiến nên họat động của tôi công khai hơn những người đấu tranh trong phong trào khác. Công an luôn theo dõi tôi và họ dọa sẽ cắt e-mail và Internet của tôi. Tôi biết có những người theo dõi, gương mặt của họ xa lạ trong khu dân cư của tôi. I am now a member of VNPP so my involvement with VNPP will be more visible to the public than many other activists of different movements. Secret police always put me under their watch and has threaten to disable my email and  internet access. I has seen some strange faces following me every where I go.

Gia Minh: Cơ duyên nào đưa cô đến với Đảng Thăng Tiến, vì trụ sở của Đảng ở Huế? What encouraged you to join VNPP since their headquarter is at Hue and you’re not living in that city?

Luật sư Lê Thị Công Nhân: Tôi tham gia ký tên vào Tuyên Ngôn dân chủ tự do ngày 8 tháng 4 năm 2006. Khi ghi tên thì ghi rõ địa chỉ e-mail, số điện thọai, sau đó tôi nhận được hồi âm từ khối 8406. Oh! I first begin signing the declaration of Freedom and Democracy promoted by the 8406 campaign . When signed I wrote down my email and telephone. I receive reply from the 8406 group.

Sau đó là quá trình giao dịch qua e-mail và tôi biết Đảng Thăng Tiến sắp thành lập; tôi thấy phù hợp với lý tưởng của tôi là đấu tranh bất bạo động cho một nền dân chủ, đa nguyên tại Việt Nam. Đó là tóm tắt quá trình tôi tham gia Đảng Thăng Tiến. Then I knew about the establishment of VNPP via contacting by emails with VNPP. I am delighted with the VNPP platform and the non-violent methods for bringing about the multi-party democratic system in Vietnam. That is basic summary of my joining the VNPP.

Cuộc sống ở Việt Nam khó khăn, thế hệ chúng tôi sinh ra trong hòan cảnh nền độc tài được hình thành và nay còn tồn tại. Tôi thấy vào thời điểm này đấu tranh công khai là cách tốt nhất để cho thanh niên biết chúng tôi. Sự công khai này là một sự dũng cảm lắm rồi. Phương tiện truyền thông phổ biến là cách thức phổ biến đường lối của chúng tôi. The living condition in Vietnam is difficult, my generation has been growing up in an autocracy system and this system is still exists. I feel that it’s important for VNPP to campaign openly so the young Vietnamese can see our effort for a PROGRESSIVE Vietnam. This kind of openly campaign requires brave heart. Utilizing public media efficiently will be one of the way for our campaign for a PROGRESSIVE Vietnam.

Đấu tranh công khai thì sẽ thu hút được sự chú ý của cả người không quan tâm. Eventually, the openly and non-violent campaign method will bring encouraging message not only to the concern but also the skeptical citizens as well.
